Federal Court Temporarily Stops USCIS Fee Increases – For How Long?

In a previous article, “Federal Court Temporarily Stops U.S. Citizenship & Immigration Services Fee Increases”, we informed you that on September 29, 2020, a federal court temporarily stopped USCIS from increasing fees and implementing new fees for USCIS applications by finding the new fee schedule to be likely unlawful.

In another article, “Federal Court Temporarily Stops USCIS Fee Increases – What Does It Mean for Me?”, we advised that for now, you may file your case using the current USCIS filing fee structure. We additionally recommended you file without delay, as the government is expected to file an appeal to fight this decision and if it wins, the new fee schedule will become effective.

You may be wondering how much time you may have to file your application before the fees potentially increase. Unfortunately, it is not possible to determine with certainty how long the new fee schedule will remain on hold. The government has up to 60 days to appeal the decision, but it is unclear as to how long the appeal process will take and/or what the outcome will be.
