DACA Travel Abroad: There Are Risks and Advantages
If you have received Deferred Action for Childhood Arrivals (DACA), “Advance Parole” allows you to travel outside the U.S. under certain circumstances.
Circumstances that allow for DACA travel abroad include:
- Urgent humanitarian purposes
- Employment purposes
- Educational purposes
DACA Travel Abroad and Advance Parole
To travel outside the U.S., you must apply for and receive an Advance Parole. However, being approved for Advance Parole does not guarantee your safe return as the Customs and Border Patrol (CBP) officer whom you will meet upon your return can deny your entry if he or she thinks you are “inadmissible.” Accordingly, it would be prudent to consult with an experienced immigration attorney before you leave the U.S. to ensure your safe return.
On a positive note, if you obtain advance parole to travel abroad, your return to the U.S. is considered a legal admission. Depending on the status of your immediate relative, this may provide a way for you to apply and obtain a green card.
