Ukraine is Designated for Temporary Protected Status (TPS)

In a past article (What is Temporary Protected Status “TPS”), we discussed that Temporary Protected Status (TPS) is a temporary immigration status provided to immigrants in the United States from certain countries who are temporarily unable to safely return to their home country because of ongoing armed conflict, a natural or environmental disaster, or other extraordinary and temporary conditions.

Ukraine Designated for TPS for 18 months

On March 3, 2022, Ukraine was designated for TPS for eighteen months based on 1) ongoing armed conflict in Ukraine, and 2) extraordinary and temporary conditions in Ukraine that prevent nationals of Ukraine to safely return to their home country.

Am I eligible for Ukraine’s 18-month TPS designation?

To be eligible you must:
– Be a national of Ukraine;
– Have continuously resided in the United States since March 1, 2022; and
– Not be inadmissible to the United States or be barred from asylum for certain criminal or national security-related reasons.

How do I apply for Ukraine’s 18-month designation?

You must register during a specific registration period by submitting an application to U.S. Citizenship and Immigration Services (USCIS) with the required application fees. The 18-month designation of TPS for Ukraine will go into effect on the publication date of the forthcoming Federal Register notice. Said date has not yet been announced.
