President Biden Revokes the Immigrant Visa Ban
On December 31, 2020, President Trump issued Proclamation 10131, continuing his prior Proclamations 10014 and 10052, which suspended the entry of certain immigrants and nonimmigrants into the United States due to possible harm to economic interests following the COVID-19 Pandemic. The proclamations have been continued until March 31, 2021.
On February 24, 2021, President Biden revoked Trump’s Proclamation 10014, which prohibited the entry of certain immigrants into the United States in light of the COVID-19 pandemic.
NOTE: Although the immigrant visa ban has been revoked, Trump’s Proclamation 10052 suspending the entry of nonimmigrant workers for the same reasons remain in place.
In light of President Biden’s policy change, the Department of State has provided instructions to the following immigrant visa applicants who were previously subject to a ban on entry pursuant to Presidential Proclamation 10014:
- – Applicants who have not yet been interviewed or scheduled for an interview;
- – Applicants whose petitions remain valid and who were previously interviewed and refused;
- – Diversity Visa 2020 applicants; and
- – Diversity Visa 2021 applicants.
