How does the process of divorce begin?

The process of divorce begins when one party files with the Court a, “Petition for Dissolution of Marriage” and has it served on the spouse. The case may then proceed to trial before a judge or the couple may negotiate a settlement on all divorce related issues, which the Court must then approve, after which, the Court will enter a “Judgment for Dissolution of Marriage”. Alternatively, if the couple cannot reach an agreement on the disputed issues, they may request that the Court conduct a pretrial settlement conference to help the parties come to agreement as to a fair settlement. If the parties still cannot come to agreement, the case will proceed to trial and the Court will decide any outstanding issues.
