Who gets custody of children in the event of a divorce?

If the parents can agree on a schedule and allocation of decision-making, custody and parental time schedules still need to be approved by the Court before it becomes valid. The Court will approve the agreement as long as it is in the child’s best interests. If the parents cannot agree on a parenting plan and/or allocation of decision-making, then the Judge will conduct a hearing and make the ruling on any points not agreed to by the parties based on what would be in the best interest of the child.
